1. Introduction

Welcome to www.maioma.com (the “Website”), operated by Maioma Limited, a company registered in England and Wales under company number 16291806.

These Terms and Conditions (“Terms”) govern your access to and use of the Website and the services provided through it (the “Services”). By using our Website or placing an order, you agree to be bound by these Terms. If you do not accept them, please refrain from using the Website.

When you place an order (“Order”), you agree to the version of the Terms in effect at that time, as published on our Website.

2. Eligibility

To use our Website and place Orders, you must be at least 18 years old and legally capable of:

  • entering into binding contracts,

  • using a valid payment method accepted by us, and

  • agreeing to and complying with these Terms.

    3. Our Services

    Maioma is a curated online marketplace. Through our Website, you can browse and purchase products from a range of independent boutiques, brands, and third-party retailers (“Partners”).

    We act solely as an agent on behalf of our Partners. This means:

    • The purchase contract is between you and the Partner, not Maioma.

    • Maioma is not the seller of the products.

    • We are authorised by our Partners to conclude sales on their behalf, but we are not a party to the sales contract.

    In addition to facilitating your purchase, we (or our logistics partners) provide delivery services. When your Order is shipped, a separate delivery contract is formed between you and us (or our delivery partner) for that service.

    4. Placing Orders

    By clicking the “Place Order” button at checkout, you are offering to purchase the items listed in your cart from the relevant Partner(s), subject to these Terms.

    You agree to pay the price listed on the Website at the time of purchase, along with any applicable delivery charges, taxes, or duties.

    Once your Order is received, we will send you an email and/or SMS confirming that we have received it. This confirmation constitutes the contract of sale between you and the Partner.

    Before placing your Order, the Website gives you a chance to review and amend any errors. It is your responsibility to ensure all details (such as item size, quantity, color, etc.) are accurate.

    We may reject Orders at our discretion for reasons such as pricing errors, payment issues, ineligibility, suspected fraud, shipping restrictions, or stock unavailability.

    5. Stock Availability

    Products in your shopping bag are not reserved until your Order is placed, fully paid, and accepted.

    Availability shown on the Website is an estimate based on the latest updates from our Partners. Due to high transaction volumes, a product may sell out before your Order is processed. If this happens, we’ll notify you and issue a full refund to your original payment method.

    6. Order Cancellations and Changes

    You may cancel or modify your Order at any time before it is marked as “Processed” in our order tracking system. To do so, please contact us directly or use the Website’s cancellation tools.

    If you cancel before processing, you’ll receive a full refund. If the Order has already been processed, it cannot be changed or cancelled — but you may return the items once received, in accordance with our return policy, and place a new Order.

    We strive to ensure all product descriptions, prices, and availability details are accurate. However, if we identify an error after you place an Order, we’ll contact you to either confirm the Order at the correct price or cancel it. If we are unable to reach you, the Order will be cancelled and a full refund issued.

    7. Payment

    When you place an Order, we carry out a standard pre-authorisation on your payment method on behalf of the relevant Partner(s). Products will not be dispatched until this verification is successful.

    If there is an issue processing your payment or Order, we may contact you to resolve it or request additional information.

    8. Delivery

    We aim to deliver your Order within the estimated delivery timeframe provided at checkout. However, these timeframes are estimates only and are not guaranteed. Delivery times may vary depending on your location, the Partner’s dispatch time, and the courier’s availability.

    Title and risk in the products will pass to you once they are delivered to the address you provided.

    We are not liable for delays caused by customs clearance, courier issues, or other circumstances beyond our control. If delivery is unsuccessful due to incorrect or incomplete address details provided by you, re-delivery fees may apply.

    9. Returns and Refunds

    You may return items in accordance with our Returns Policy, available on the Website. In general:

    • Items must be returned unused, in their original condition and packaging, with all tags attached.

    • Returns must be initiated within the return window specified in the policy.

    • Refunds will be processed back to your original payment method (or other options such as store credit, where applicable) after the returned items are received and inspected.

    • If you paid using Cash on Delivery, refunds may be issued via bank transfer, store credit, or another method, as specified in our Returns Policy.

    If you are returning a product due to damage, defect, or incorrect delivery, we will cover the return shipping cost. For other reasons (such as change of mind or cancellation of a COD order after dispatch), you may be responsible for the return shipping fees.

    Refunds will be processed once returned items pass inspection. Please allow up to 14 days for the refund to appear, depending on your bank or payment provider.

    10. Gift Cards & Store Credit

    • Gift Cards purchased from Maioma can be used on any eligible product unless otherwise restricted.

    • Gift Cards are non-refundable and cannot be exchanged for cash.

    • Lost or stolen Gift Cards will not be replaced.

    • Store Credit may be issued as a refund method or as part of a promotional offer. It is non-transferable, non-redeemable for cash, and subject to expiration dates where applicable.

    11. Product Details & Pricing

    Product details (e.g., description, images, sizing, prices) are provided to us by our Partners. We make every effort to display this information accurately, but we cannot guarantee that descriptions or pricing are always error-free or current.

    If an error in pricing is discovered after you place an Order, we will contact you to reconfirm or cancel. If we are unable to reach you, the Order will be cancelled and refunded.

    12. Your Account

    You may create an account on our Website to access order history, wishlist, and faster checkout.

    You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. We reserve the right to suspend or terminate accounts that misuse the Website or breach these Terms.

    13. Intellectual Property

    All content on the Website—including images, product listings, logos, graphics, design, and text—is owned by or licensed to Maioma and/or its Partners and is protected by copyright, trademark, and other intellectual property laws.

    • Attempt to gain unauthorised access to any portion of the Website or related systems;

    • Make purchases for commercial resale without our prior consent.

    We reserve the right to suspend or terminate access to any user who violates these Terms or engages in conduct we deem harmful to Maioma or our Partners.

    15. Complaints & Dispute Resolution

    If you have a complaint about your Order or the Website, please contact us at support@maioma.com. We aim to resolve all customer service issues promptly and fairly.

    If a dispute arises and cannot be resolved informally, it may be referred to the courts of England and Wales, subject to governing law below.

    16. Limitation of Liability

    To the extent permitted by law:

    • We are not liable for any indirect, incidental, or consequential damages.

    • We are not liable for any loss or damage resulting from the use of the Website or the delay/failure of a Partner to fulfil an Order.

    • We are not liable for delays, errors, or losses caused by events beyond our reasonable control.
    • We provide the Website and Services “as is” and make no warranties regarding functionality, availability, or accuracy.

    • Our total liability to you under these Terms shall not exceed the total amount paid by you for the Order in question.

    Nothing in these Terms affects your statutory consumer rights.

    17. Indemnity

    You agree to indemnify and hold harmless Maioma, its directors, employees, and affiliates from any claims, losses, damages, liabilities, or expenses arising out of:

    • Your misuse of the Website,

    • Your breach of these Terms,

    • Your violation of any law or third-party rights.

      18. Third-Party Links

      The Website may contain links to external websites. These are provided for your convenience only. We do not endorse or have control over the content of those websites and accept no responsibility for them or for any loss or damage that may arise from your use of them.

      19. Force Majeure

      We are not liable for any failure or delay in performing our obligations caused by events outside our reasonable control, including but not limited to natural disasters, war, strikes, pandemics, and government restrictions.

      20. Privacy

      Your privacy is important to us. Please refer to our Privacy Policy, which explains how we collect, use, and protect your personal data when you use our Website or Services.
